General Terms and Conditions for Running Supporter TCS Amsterdam Marathon

These general terms and conditions are applicable to the ‘Hardloopsupporter’ campaign (hereinafter referred to as: the Campaign’) organised by Nationale-Nederlanden. This campaign was initiated by Nationale-Nederlanden.

The Campaign will be realised on From Tuesday 1 October through to 10:00am on Sunday 20 October 2019, it will be possible to submit encouragement videos for the TCS Amsterdam Marathon on Sunday 20 October 2019. The purpose is to show as many encouragement videos as possible to participants in the TCS Amsterdam Marathon. After the TCS Amsterdam Marathon, the submitted encouragement videos can be viewed at

Nationale-Nederlanden reserves the right to stop the Campaign or amend the General Terms and Conditions at any time without providing reasons for doing so. A revised version of the General Terms and Conditions will then be placed at, stating the date of amendment.

By sending in an encouragement video, an agreement is made between, on the one hand Nationale-Nederlanden Nederland B.V., with its offices at Schenkkade 65, 2595 AS Den Haag, “Nationale-Nederlanden” or “NN”, and the natural person who has submitted the encouragement video, hereinafter “Participant”, on the other.

1. Participation

1. Participation in the campaign is free;

2. Subject of the agreement

Nationale-Nederlanden is the rights holder for the campaign page. Nationale-Nederlanden provides the Participant with a non-exclusive right to access and use the campaign page.

3. Personal data

3.1 Nationale-Nederlanden, or a processing party designated by it, will process personal data of the Participant exclusively for the purposes of the Campaign. Nationale-Nederlanden will take technological and organisational measures to guarantee a suitable level of protection.

4. Intellectual property

4.1 Including after the moment of submission, the Participant will retain the intellectual property and other rights to which he or she is entitled;
4.2 As of the moment of submission to Nationale-Nederlanden, the Participant will retain an unlimited usage right, at no charge, inter alia for publication of the submission in the broadest sense of the word, including, but not limited to, use for all possible media, including internet and national daily newspapers and weekly magazines.

5. Exclusions

5.1 Nationale-Nederlanden reserves the right to exclude submitted encouragement videos of supporters from the campaign, if these contain inappropriate, damaging, libellous, insulting, threatening, infringing, improper or unlawful images, texts, subjects, names, materials or information;
5.2 Nationale-Nederlanden cannot be held liable for any (consequences) loss caused by technical or editorial errors or negligence occurring on the website, nor for any loss/consequential loss resulting from use, presentation, making available or the temporary non-availability of the website.

6. Realisation of the campaign

6.1 Nationale-Nederlanden cannot guarantee that an encouragement video submitted by a Participant will actually be shown during the TCS Amsterdam Marathon 2018;
6.2 The Campaign runs from Tuesday 1 October to Sunday 20 October 2019;

6.3 Nationale-Nederlanden is not responsible for any loss arising from the encouragement videos shown during the TCS Amsterdam Marathon on 21 October.

7. Other provisions

71 Nationale-Nederlanden rules out every form of liability against it;

7.2 This agreement is subject to Dutch law;
7.3 A dispute exists if one of the two parties considers it so. In such cases, the Court of Amsterdam has exclusive competence to hear the dispute.
